This Privacy Policy explains how Adventure Capital Inc. (operating as “Adventure 33”) (“Adventure 33”, “we”, “us”, “our”) collects, uses, and protects personal information in connection with the Prism web application and related services (the “Service”).

Prism is a business-to-business (B2B) platform used by radio stations and other organizations. It is not intended for use by consumers or the general public.

By using the Service, you agree to the practices described in this Privacy Policy.

2. Scope

This Privacy Policy applies to:

Users who log into and use the Prism Service; and

Customer data that we process on behalf of our business customers in connection with providing the Service.

It does not apply to any third-party websites or services that may be linked to from the Service.

We collect personal information in two main ways:

3.1 Information you or your organization provide

Your organization (the Customer) may provide us with personal information about you when creating or managing your user account, such as:

Name

Work email address

Job title or role (for access control)

Organization name

We may also maintain records of communications with you (for example, support requests).

3.2 Information collected automatically

When you access or use the Service, we automatically collect certain information, including:

IP address

Browser and device information

Dates and times of access

Log and audit information about your actions within the Service (for example, when you log in, change settings, schedule broadcasts, or upload assets)

This information is used for security, troubleshooting, performance monitoring, and audit purposes.

4. Customer Data we process on behalf of organizations

The Service is designed to store and process business data for our customers. This may include:

Metadata triggers

Activity audit logs

Audio assets (e.g., content to be broadcast)

Broadcast event schedules and related configuration data

In many cases, this information will not identify individuals, but some data may contain personal information depending on how the Customer uses the Service.

When we process Customer Data that includes personal information, we do so as a service provider/processor on behalf of the Customer. The Customer is responsible for ensuring it has the right to provide us with that data and for complying with applicable privacy laws.

We use personal information for the following purposes:

To provide and operate the Service

Managing user accounts and authentication

Enforcing role-based access and permissions

Processing and storing Customer Data as configured by the Customer

To maintain security and integrity

Monitoring for unauthorized access or misuse

Operating audit logs and security logs

Supporting optional multi-factor authentication (MFA)

To support and communicate with you

Sending operational or security notices related to your use of the Service

To improve the Service

We do not sell personal information or use the Service for advertising.

6. Analytics and cookies

We do not use third-party analytics tools (such as Google Analytics, Hotjar, or similar) within the Prism Service.

We use only our own server and application logs and rely on essential cookies and similar technologies where needed to:

Maintain a secure session after you log in

Store basic preferences necessary for the function of the Service

7. Legal bases (where applicable)

Where applicable privacy laws require a legal basis for processing (for example, the GDPR for EU/UK users), we rely on one or more of the following legal bases:

Performance of a contract (providing the Service to your organization);

When we process personal information solely on behalf of a Customer as a service provider/processor, Customer’s legal basis and instructions govern.

8. Data location and transfers

We currently host the Service primarily in Canada and the United States. As we add customers in other regions, we may deploy infrastructure closer to those customers (for example, in Europe).

This means personal information may be stored and processed in countries other than your own. These countries may have different data protection laws than the laws of your jurisdiction.

Where required by law, we will take appropriate measures to protect personal information when it is transferred across borders and will work with Customers to address any specific regulatory requirements (for example, data transfer arrangements for EU/UK data).

9. How we share personal information

We may share personal information with:

Service providers who help us operate the Service (for example, hosting and infrastructure providers), under contracts that require them to protect personal information and use it only for our business purposes;

Your organization (Customer), for example in the form of user management, audit logs, and administrative controls;

Authorities or other parties if required by law, subpoena, or court order, or if we reasonably believe disclosure is necessary to:

Protect our rights, security, or property;

Protect the rights, security, or property of Customers or others; or

Investigate suspected fraud or security incidents.

We do not sell personal information.

10. Retention

We retain personal information for as long as necessary to:

Provide the Service to the Customer;

Comply with legal and regulatory requirements;

Resolve disputes and enforce agreements; and

Maintain appropriate business records.

Log data and backups may be retained for a limited period consistent with our security and backup practices, even after other data has been deleted or anonymized.

11. Your rights

Your rights regarding personal information may depend on your location and your organization’s contract with us. Depending on the applicable law, you may have rights to:

Access personal information about you;

Request correction of inaccurate personal information;

Request deletion of personal information, subject to legal and contractual limitations;

Object to or request restriction of certain processing;

Withdraw consent where we rely on consent (if applicable);

Lodge a complaint with a data protection authority.

In most cases, because we act as a service provider/processor to your organization, you should direct requests first to your organization (the Customer). We will assist the Customer in responding to such requests where required by law and by our agreement.

12. Security

We use technical and organizational measures designed to protect personal information, including:

HTTPS/TLS for data in transit;

Encryption at rest for databases and storage used by the Service;

Role-based access control;

Optional multi-factor authentication (MFA);

Access controls and logging for administrative access.

No system can be guaranteed to be completely secure, but we strive to protect the data we hold in a manner appropriate to its sensitivity.
